Sony Not Done With Fight Over Spotify Income


Sony isn't done with a battle over how much income it derives from Spotify and how much of that money it gives back to artists whose music generates that revenue. The company was sued by 19 Recordings back in February 2014 over streaming income paid to 19 Recordings artists including Kelly Clarkson, Clay Aiken and Carrie Underwood. The suit alleged that Sony was treating streaming music as sales or distributions rather than as broadcast or transmissions, claiming a breach of duty of good faith and fair dealing. That claim was dismissed by a New York federal judge earlier this month, though a second claim over breach of contract was allowed to proceed. Now, 19 Recordings wants the judge, Ronnie Abrams, to reconsider, but has asked the matter be moved to a higher court so that the judge doesn't have to reverse his own ruling. If the judge agrees, the matter will be heard by the 2nd Circuit Court of Appeals. No word on when Judge Abrams will issue a ruling on the appeal.
