70s teen idol Peter Frampton has filed a lawsuit against A&M Records over digital royalties the singer claims he never received. Frampton charges breach of contract and seeks compensatory damages in the suit, which was filed this week. The basis of the lawsuit lies in the way that digital royalties are calculated. According to Frampton's complaint, he should have been paid 50 percent of receipts for all digital sales of his music, the standard going rate, but A&M paid him for those sales based on the lower rate associated with physical sales.
Representing Frampton in the case is Nashville lawyer Richard Busch, who represented rapper Eminem in a similar suit over digital royalties. Eminem lost the case in a lower court before an appeals court ruled in his favor, ordering Universal to pay him 50 percent of his digital sales.
