Pop icon and self-proclaimed "Material Girl" Madonna lost a key pre-trial ruling in case where she is being sued for using the "Material Girl" brand for her new clothing line. LA Triumph, an LA-based clothing retailer, has been selling "Material Girl" brand clothing since 1997 and has trademarked the name. Madonna's defense team had motioned for the court to throw the case out because the singer had "established trademark primacy" over the name with her hit 1985 song. The judge also ruled against the defense's claim that Madonna has been selling merchandise branded with the slogan for years, referring to $85 million worth of shirts, buttons and hats sold at concert concession booths. The case is scheduled to go to trial in October.
